Installer terms
Version pro-terms-2026-10-28. Operated by NOVALY LLC, a Wyoming (USA) limited liability company trading as Backyard Mate ("we", "us"). These terms are a contract between us and the business that opens an installer account ("you"). Open an account or take a lead and you accept them.
1. What Backyard Mate is
We run an online introduction service. Homeowners use our free visualiser, see an indicative price and may ask to be contacted by one local installer. We pass that request to you as a lead. We are not a builder, not your agent and not a party to any quote, contract or work between you and a homeowner. We make no promise that a homeowner will answer, proceed, or hire you.
2. Your account
You must be an Australian business with an ABN, hold the licences, registrations and insurance your work requires, and give us accurate details. We check every account before activating it and may decline or pause an account without giving a reason. One account per business. You are responsible for anyone who uses it.
3. What a lead is
A lead is a homeowner who verified their mobile by tapping a link we texted to it, and agreed in writing to be called by one local installer about a free quote within 90 days. Each lead shows the project, the photo, the AI concept and the indicative price the homeowner saw. Contact details appear only after you take it. Each lead is sold to one installer only. The homeowner remains free to get other quotes elsewhere.
4. Prices and credit
Joining is free. You pay only for the leads you take, from prepaid credit, at the price shown before you confirm. Prices are in Australian dollars and carry no GST (see clause 12). Credit never expires. We may change lead prices with 30 days' notice by email; a change applies to leads taken after the notice. If you disagree with a change, close your account and we refund your unused credit.
5. Credit back on a bad lead
Report a lead within 7 days of taking it, in the app (Taken, then Report), and we return the credit when one of these is shown:
- Disconnected or invalid number. Send us a screenshot of your call log showing the network message (for example "the number you have called is not connected") to [email protected]. We text the homeowner a one-tap check and call the number ourselves. If the homeowner taps the link, the number works and the lead stands.
- Not asked for. The homeowner tells us they never asked for a quote. When you report this we text them a one-tap question; if they answer that they never asked, the credit comes back at once. If they confirm they asked, or do not answer, the lead stands.
- Duplicate. The same mobile number was sold to you in the previous 30 days. We check this automatically.
- Outside your area. The postcode was outside the service area set on your account when you took the lead. We check this automatically.
We decide within 3 business days of your report and tell you the outcome. A credit is returned to your account balance, not paid out, unless you are closing your account. We do not return credit because the homeowner did not answer, changed their mind, chose another installer, found the price too high, or was "just looking": a lead is an introduction, not a sale.
6. How you use homeowner details
Use a homeowner's details only to contact that homeowner about that project, within 90 days of taking the lead, by phone, SMS or email, and stop as soon as they ask. Never sell, share, trade or add them to any list or marketing. Keep them secure and delete them once the project is over or declined. You must comply with the Privacy Act 1988, the Spam Act 2003 and the Do Not Call Register Act 2006; the homeowner's consent is passed to you with the lead and is valid for 90 days. You are responsible for your own compliance and will cover any loss, claim or penalty we suffer because you breached this clause.
7. Your work
You are an independent business. You quote, contract, build and warrant your work directly with the homeowner, and you handle council approvals. You are responsible to the homeowner under the Australian Consumer Law and your trade laws, not us. You will cover any claim made against us that arises from your quotes, your work, your conduct or your use of a lead.
8. AI designs
Each active account gets free AI designs every month; each extra design is taken from your credit at the price shown on the button, and a design that fails costs nothing. Photograph a property only with the owner's permission and without people in the shot. Photos are processed by our AI provider to create the image and are not used to train its models. AI images are concepts, not plans, measurements or quotes.
9. The service
We work hard to keep the service running but do not promise it will be uninterrupted or error free, or that any number of leads will be available in your area. Lead details come from the homeowner; we check what we reasonably can but cannot guarantee they are complete or accurate. We may change features with notice.
10. Our liability
Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded. Otherwise, our total liability to you for anything arising from these terms or the service, in contract, tort or any other way, is limited to the amount you paid us in the 12 months before the claim, and we are not liable for loss of profit, business, opportunity or any indirect or consequential loss.
11. Pausing and closing an account
You may close your account at any time and we refund your unused credit, less the payment processor's fees. We may pause or close an account that misuses homeowner details, gets repeated complaints, uses a card or ABN that is not its own, holds no required licence, or breaks these terms; where practical we tell you first. If we close your account for a reason other than those, we refund your unused credit. If we close an account for fraud or misuse of homeowner details, we may hold back from its unused credit the amount of any loss, refund, claim or penalty that misuse caused, and refund the rest.
12. Tax and invoices
We are a non-resident of Australia, do not carry on an enterprise in Australia, and are not registered for Australian GST; no GST is charged and no ABN is quoted. You get a PDF invoice in your business name for every card top up, in your account. You confirm, when you tell us so at sign up, that your business is registered for GST and buys leads for business use, and you will tell us if that changes.
13. Changes and disputes
We may update these terms with 30 days' notice by email; keep using the service after that date and the new terms apply, or close your account before it and we refund your unused credit. These terms are governed by the laws of Western Australia and its courts. If something goes wrong, email us first at [email protected]; we answer within 5 business days.
